Data Sovereignty at Stake: US-Indonesia Agreement’s Digital Trade Impact
The Digital Sovereignty Dilemma in the US-Indonesia Trade Agreement
Despite being praised as a “New Golden Age” for trade, the US-Indonesia Agreement on Reciprocal Trade (ART) presents a complex issue for Jakarta. A key point of debate lies in Article 3.2, “Digital Trade and Technology.” Indonesia’s goal to “facilitate digital trade” clashes with its Personal Data Protection (PDP) Law from 2022.
This legislation emphasizes the free flow of data across “trusted borders,” aligning digital standards between the two nations. According to the U.S. Trade Representative, it prevents discriminatory data transfer practices. By accepting U.S. standards, Indonesia may find its local data residency rules limited.
For observers, the agreement is more than just trade facilitation; it represents a shift in domestic regulation in return for market access, which could be precarious.
Three Key Areas of Focus
- Non-Discrimination: Indonesia must prevent unfair practices against U.S. digital services, including software and online platforms.
- Trusted Data Flows: The agreement supports cross-border data movement, recognizing areas with suitable data protection and easing business operations.
- Cybersecurity Collaboration: The countries will boost digital security cooperation, including threat information sharing and protection against unauthorized access.
Tension with National Legislation
Indonesia’s regulations, like Law No. 1 of 2024 and the PDP Law, permit data flow under strict conditions. The ART aims to align Indonesia’s civil approach with U.S.-style systems. However, the PDP Law enforces strict penalties for non-compliance, which ART acknowledges while respecting local frameworks.
Concerns Regarding Implementation and Sovereignty
Despite optimism, the agreement faces criticism. Minister Meutya Hafid emphasizes the PDP Law as paramount on data issues, while critics fear the “trusted borders” could restrict Indonesia’s data regulation abilities.
The ART’s success hinges on the forthcoming Council of Trade and Investment’s dispute resolutions, balancing innovation and national sovereignty.
